Validity of a trademark registration
Once the trademark is registered, it is valid for a period of 10 years from the date of application. The registration can then be renewed indefinitely as long as the renewal fees are paid every 10 years.There is no limit to the number of times a trade mark registration may be renewed. Any person may pay for the renewal.
A renewal application can be made within six months before the expiry of the registration of the mark. The procedure of trademark renewal starts with a step of a request for a trademark renewal in India by paying the trademark renewal fee in a prescribed form. The Trademark Office may remove the trademark if the mark is not renewed before the last expiry date and advertise the same in the Trademark Journal, The Trademark law provides another six months from the date of expiry within which an application (which is different from the one filed before expiry of registration) can be made to revive and retain the registration.
trademark rights can last indefinitely if the owner continues to use the mark. However, if a registered trademark is not renewed, it is liable to be removed from the trade mark registry.
